Terms and Conditions for Vario One

This translation is for information only. The contract language is German. If the versions differ, the German version prevails, as far as the law allows.

Version 3 · As of 29 October 2026

1. Who we are and what these terms apply to

1.1 The provider of Vario One is Leobalo GmbH, Schwester-Jovita-Str. 15, 64625 Bensheim, Deutschland, represented by its managing director (Geschäftsführer) Tino Volbracht, e-mail: , Amtsgericht Darmstadt (local court), HRB 97939, VAT ID DE815771279 (“we”).

1.2 These terms apply to the use of the Vario One app on iPhone, Apple Watch and Android (the “app”), to a user account and to the related online services, such as syncing the flight book, route planning on vario-one.com and group flying (together the “services”).

1.3 The app is aimed at consumers. Any different terms proposed by users do not apply.

1.4 For downloading the app and processing purchases, the terms of the respective store (Apple App Store or Google Play) also apply.

2. What Vario One is – and what it is not

2.1 Vario One is an app for paraglider and hang glider pilots. Among other things, it indicates climb and sink through sound and on the display, altitude, a map with launch and landing sites, airspaces with warnings, wind and thermal information, traffic, the positions of fellow pilots, a flight book and route planning. The individual features are listed in the app and on vario-one.com.

2.2 Vario One is an aid. The app is not an approved or certified flight instrument and does not replace required instruments, your flight preparation, airspace charts, official weather information or your own observation.

2.3 Data may be missing or differ. Airspace, terrain, weather, traffic and launch site data come partly from third parties. They may be incomplete, out of date or inaccurate. The airspace data comes from OpenAIP, a database maintained by volunteers, and is not official aeronautical data; only the official publications (AIP, NOTAM) are binding. The app calculates or estimates altitude, compass heading, wind and thermals using sensor readings, GPS and air pressure. These can differ significantly, for example due to magnetic fields, missing calibration, inaccurate GPS or too few circles for the wind calculation.

2.4 Warnings can fail. Sounds, announcements and warnings depend on the device: for example on the battery, volume and mute setting, power-saving features, permissions, sensors, Bluetooth connections and network reception. A missing warning does not mean there is no danger.

2.5 You decide. Responsibility for every flight, for compliance with air traffic rules and for your safety lies with you as the pilot.

3. Agreeing to these terms

3.1 Before you take out a subscription, restore a purchase or use the free map for the first time, and with every new version, the app shows you these terms and the safety notices. With “Agree and continue” you accept the version shown. Without your agreement you cannot use the app; an existing subscription does not end as a result.

3.2 Agreeing to these terms is not consent to data processing. Where we need consent, we ask separately.

3.3 The app stores which version you agreed to and when (details in the Privacy Policy).

4. Account

4.1 You can use many features without an account. To sync the flight book between devices, for route planning on vario-one.com and for group flying, you need an account. You sign in with your e-mail address and a one-time code, on iPhone also with “Sign in with Apple”. Existing accounts can also sign in on Android with their password.

4.2 You must provide your own e-mail address at which you can be reached and protect your account against access by third parties.

4.3 Once an account is confirmed, the app automatically syncs your flight book, your pilot data, routes and waypoints with our server. If you do not want this, use the app without an account.

4.4 You can delete your account at any time: in the app or at vario-one.com/en/konto-loeschen. What is deleted and when is set out in the Privacy Policy. A running subscription does not end as a result; cancel it in the store.

5. Free use and subscription

5.1 Without a subscription you can use the map with launch and landing sites free of charge. The other features require a subscription. Which features are part of the subscription is shown in the app before you buy.

5.2 Subscriptions are available with different terms. The store shows you the price, term and any free trial before you buy. A subscription on iPhone also applies to the Apple Watch app.

5.3 Conclusion of contract and payment. You take out the subscription in the App Store or on Google Play following the process set out there. Before you place your binding order, the store shows you the term, price, any free trial and the payment terms; you receive the confirmation from the store. The store handles the billing and is responsible for payment, invoice and refunds.

5.4 Renewal and cancellation. The subscription renews automatically for the chosen term unless you cancel it in the store beforehand. You can cancel at any time in the subscription settings of your store; the subscription then runs until the end of the paid period. Deleting the app or the account does not end a subscription.

5.5 Free trial. If you do not cancel a free trial in good time before it ends, the paid subscription begins. The store shows you the deadline.

5.6 Price changes for running subscriptions are announced via the store; the store’s rules apply, in particular on your agreement or your right to cancel.

5.7 Restoring a purchase. On a new device or after reinstalling, you can restore an existing subscription in the app.

5.8 Offers and codes. From time to time we offer discounts, free trials or offer codes, for example for members of flying schools and clubs. You redeem codes in the respective store; a code for the App Store does not work on Google Play and vice versa. The terms the store shows you before you redeem apply (discount, duration, redemption deadline). Codes cannot be exchanged for money. After the offer ends, the subscription renews at the regular price unless you cancel it beforehand.

6. Right of withdrawal

6.1 As a consumer, you have a statutory right of withdrawal when you take out a subscription. You learn the period, how to exercise it and its consequences before you buy, from the withdrawal notice in the store’s purchase process. Because the purchase is processed via the store, send your withdrawal notice or refund request to the store where you made the purchase. You can also contact us about this ().

6.2 Your right of withdrawal does not expire merely because you download or open the app, agree to these terms or start a free trial. It can only expire early under the statutory conditions (Section 356(5) of the German Civil Code (BGB) for services, Section 356(6) BGB for digital content), in particular if you have expressly agreed to the start before the end of the period and confirmed that you thereby lose your right of withdrawal.

7. Intended use and your obligations

7.1 Use the app only within the applicable laws, in particular the air traffic rules.

7.2 Before every flight, check that the app, the map and airspace data and any connected devices are working, and set the volume, battery, permissions and power-saving features of your device so that the app can run in flight.

7.3 Only use the app during a flight when it is safe to do so.

7.4 Traffic and group displays (SafeSky, group flying) show only aircraft and people whose data is actually transmitted. They do not replace watching the airspace and the right-of-way rules. Do not rely solely on the app for automatic QNH, maps and airspace warnings either.

7.5 If you share your position with others (group flying, SafeSky) or pass on routes by link, you decide who gets access to this data. Do not share other people’s data without their permission.

7.6 You must not misuse the services, in particular you must not query them automatically, bypass their security, overload them or post content that infringes the rights of third parties.

7.7 If you seriously breach these obligations, we may block your account after prior warning; in the case of severe breaches also without warning. The right to terminate for good cause remains unaffected.

8. Third-party services and content

8.1 Some features use third-party services, such as map providers, OpenAIP (airspace), kk7 (thermals), Holfuy (weather stations), SafeSky (traffic), XContest and DHV-XC (flight upload). The terms of the respective providers also apply to these services. We have no influence on their availability and accuracy.

8.2 You use SafeSky, XContest and DHV-XC only if you activate them in the app or start an upload. For XContest and DHV-XC you need your own account with the respective provider.

9. Availability, updates and defects

9.1 We strive to keep the online services constantly available. Maintenance, faults and outages of networks or third-party services can temporarily limit use. Many core features (Vario, altitude, recording) work without a network.

9.2 During the term of your subscription we provide the updates needed for the app to work in line with the contract, including security updates (Section 327f BGB). If you do not install such an update although we have informed you about it, we are not liable for defects based solely on that.

9.3 We may develop the app further and change features if this is reasonable for you, for example for technical or legal reasons or because third-party data changes, and the overall service of the subscription does not become significantly worse (Section 327r BGB). If a change impairs your access or use by more than a trivial amount, we inform you in good time beforehand on a durable medium (e.g. by e-mail); you then have the statutory rights, in particular ending the contract.

9.4 In the case of defects, the statutory rights for digital products apply (Sections 327 et seq. BGB).

9.5 The app runs on the operating system versions stated in the stores. We cannot support older devices or versions indefinitely.

10. Liability

10.1 We have unlimited liability for intent and gross negligence, for death, personal injury or damage to health, under the German Product Liability Act (Produkthaftungsgesetz) and to the extent that we have given a guarantee.

10.2 In the case of slight negligence we are liable only if we breach an essential contractual obligation, that is, an obligation whose fulfillment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely. In this case our liability is limited to the foreseeable damage typical of the contract.

10.3 Otherwise our liability for slight negligence is excluded. Statutory warranty rights and claims for fraudulently concealed defects remain unaffected.

10.4 These limitations also apply to our employees and agents.

10.5 The notices in section 2 describe the limits of the app. They do not limit our liability under clause 10.1.

11. Rights to the app and to your content

11.1 With a valid subscription, or for the free features, you receive a non-exclusive, non-transferable right to use the app for private purposes. The app, its content and trademarks remain our property or that of our licensors.

11.2 Your flights, routes, waypoints and other content belong to you. You grant us only the rights we need to store them, sync them between your devices and pass them on to others at your request (e.g. by share link or upload).

11.3 You can export your flights individually as an IGC or GPX file.

12. Term and end of the user contract

12.1 The user contract runs for an indefinite period. You can end it at any time by deleting your account or uninstalling the app; you cancel a subscription separately in the store (clause 5.4).

12.2 We can terminate the user contract for free features with four weeks’ notice. A paid subscription remains unaffected by this until the end of the paid period.

13. Changes to these terms

13.1 The version you agreed to applies. If we change these terms, the new version gets a date and a number. Before further use, the app shows you what has changed and asks for your express agreement. Silence does not count as agreement.

13.2 If you do not agree, you cannot continue using the app. You can cancel a running subscription in the store. Your statutory rights remain unaffected; if you have questions about this, get in touch via our contact form (vario-one.com/en/kontakt).

13.3 You can view earlier versions on vario-one.com.

14. Age

You can use Vario One from the age of 16. If you are younger, you need the agreement of your parents or legal guardians.

15. Organizations on vario-one.com

15.1 Flying schools, clubs, shuttle services and competitions can create an organization on vario-one.com and use it to publish briefings for their pilots. Anyone who creates or manages an organization must be authorized by it to do so. The organization is responsible for the content it publishes.

15.2 Data processing on behalf of the organization. We process personal data of other people that the organization enters – above all the name, role, phone number and WhatsApp group of its contact persons and the e-mail addresses of invited members – on its behalf (Art. 28 GDPR). The following applies:

  • Subject and duration: We store this data and display it in the organization’s briefings or send invitations, until the organization deletes the entries or is dissolved.
  • Instructions: We process the data only as the organization sets it up with the features of vario-one.com. It gives further instructions in text form via our contact form (vario-one.com/en/kontakt) or by e-mail. If we consider an instruction unlawful, we tell the organization.
  • Confidentiality and security: Anyone with access on our side is bound to confidentiality. We protect the data with appropriate technical and organizational measures (Art. 32 GDPR), including encrypted transmission, access only for authorized people and regular backups. We send a description on request.
  • Sub-processors: Hetzner Online GmbH (servers in Germany) and ALL-INKL.COM – Neue Medien Münnich (sending the invitation e-mails). We announce new sub-processors in advance; the organization can object for good cause.
  • Support: We help the organization with requests from data subjects and with its obligations under Art. 32 to 36 GDPR and report data breaches to it without undue delay.
  • Deletion: If the organization deletes entries or itself, we delete the data; backup copies expire according to the periods in the Privacy Policy.
  • Evidence: We provide the organization with the necessary information and allow audits by prior arrangement.

15.3 The organization ensures that it is allowed to enter the data and that the data subjects are informed about it.

16. Dispute resolution

16.1 We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

16.2 The former EU online dispute resolution platform has been discontinued; there is therefore no link to it.

16.3 If you have questions or complaints, you can reach us via our contact form (vario-one.com/en/kontakt).

17. Final provisions

17.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection rules of the country in which you have your habitual residence remain unaffected.

17.2 If a provision is invalid, the others remain valid. The statutory rule takes the place of the invalid provision.

17.3 The contract language is German. Translations are for information; if the versions differ, the German version prevails, as far as the law allows.
